The Supreme Court considers that surrogacy harms the child and exploits the woman

The ruling of the High Court criticizes that children and pregnant mothers are treated as objects and their dignity and fundamental rights as people are violated

The plenary of the First Chamber of the Supreme Court considers that surrogacy contracts entail damage to the interests of the child and exploitation of women that are "unacceptable", in addition to "objectifying" and depriving children and pregnant mothers of their dignity and rights as persons.

This is stated in their ruling on a cassation appeal filed by the prosecutor's office against a sentence in which it declares the maternal filiation of a woman who was not the biological mother of a child born of a surrogacy pregnancy -without providing genetic material- in Mexico through a contract with a mediation agency.

The ruling makes it clear that the so-called "surrogacy" is prohibited in Spain and charges harshly against the practice of surrogacy and against agencies that profit from this type of business.
