The Court of Barcelona has sentenced to permanent prison reviewable the man accused of letting his diabetic partner die and recording his agony with his mobile, without helping her despite his state of vulnerability, in June 2019 at his home in Viladecans.
In the sentence, to which Efe has had access, the Court of Barcelona, in line with the verdict of the popular jury, attributes to the accused, Mariano Daniel Vásquez, a crime of murder with cruelty, three of mistreatment in the field of sexist violence, one of habitual abuse and one against the privacy of women, a person "especially vulnerable because of his illness".
He did not give him any help and watched as it deteriorated.
The sentence considers proven that between February and March 2019 Mariano Daniel Vásquez maintained a sentimental relationship, without coexistence, with the woman, and that over time he was imposed on the victim, controlling and belittling her in public and in private, causing her to feel inferior, and that he also beat her on several occasions.
On the night of June 17, 2019, according to the sentence, the woman was very unwell and called Mariano to come to her home to help her. When the man arrived at the victim's home, he found her very physically deteriorated, with respiratory distress and no ability to do anything on his own, although he did not give her any help and was contemplating how she was deteriorating, lost consciousness and was "shutting down her life", until she suffered a hyperglycemia that caused her death.

According to the Court, the death of the woman "would not have occurred" if the man, seeing her condition, had asked for help from the emergency medical services. In addition, the sentence that the defendant recorded with a mobile phone the woman in her progressive deterioration "to show the images to third parties", to try to show that he took care of her "and thus build an alibi" in case her death was investigated.
"Being easy for the defendant to ask for medical assistance, his passive behavior in this regard, since he neither asked for medical assistance nor help of any kind, when it was evident, in view of the recording, that the dying woman could not ask for help from anyone, it must inevitably be concluded that Mariano wanted the death (of the victim) to occur or that he was indifferent to him, "- notes the sentence.
Brutality
Regarding the cruelty, he assures that it is evident that in this case it is not determined by the long agony suffered by the victim, since the accused cannot be reproached that the woman did not die before, but that he let her die without "doing anything" to avoid it.
"The defendant increased the pain of the victim with his burlesque behavior, which he also recorded on video, the woman being in such deplorable conditions that she would surely not want anyone to see her," the Court emphasizes.
In fact, one of the main pieces of evidence used by the jury to support its conclusions was the videos recorded by the defendant himself at the victim's home when she spent hours in agonizing state and in constant deterioration of her physical and mental faculties.
